ANJ Fines SPS Betting EUR 800,000 for Self-Exclusion Failure
The Autorité Nationale des Jeux (ANJ), France’s gambling regulator, has imposed a record EUR 800,000 fine on SPS Betting, the operator of the Unibet brand in France. This fine is the largest ever issued by the authority and underscores the seriousness of the issue at hand.
Unibet’s Self-Exclusion Malfunction
ANJ revealed that the Unibet brand experienced a significant malfunction related to self-exclusion, allowing self-excluded players to continue placing bets for an extended period. This failure posed a risk to vulnerable customers and raised concerns about responsible gambling practices.
The malfunction, which affected only iOS users, persisted for nearly two years, starting in March 2021 and ending in December 2022 when Unibet finally rectified the issue. However, the problem resurfaced for an additional three months before being fully resolved.
While the exact number of self-excluded players who used the platform during the malfunction remains unknown, estimates suggest it should not exceed 100 players. SPS Betting reported that over 4,500 player accounts were impacted, although ANJ approximated the figure at 6,754.
ANJ’s Response and Fine
Due to the severity of the violations, the prolonged nature of the malfunction, and the inadequate initial remediation efforts, ANJ decided to impose its largest fine to date. The regulator stressed the importance of self-exclusion in regulated online gambling and the need for companies to adhere to these principles.
Notably, Unibet had previously been fined twice in France, with the most recent penalty related to breaching the country’s return to player (RTP) limit of 85%. The operator has two months to appeal the decision and must display a message about the fine on its homepage.
Unibet’s Troubles in the Netherlands and France’s Tax Increase
Aside from the fine in France, Unibet has encountered legal challenges in the Netherlands regarding lawsuits from former players seeking compensation for losses incurred before the company obtained regulatory approval in the country. Such lawsuits have become more common in regulated markets, despite operators’ attempts to prevent them.
Meanwhile, France recently implemented a tax hike on certain gambling products, initially considering abandoning the plan but ultimately reinstating it in the new budget. La Française des Jeux (FDJ), one of the leading operators in France, remains optimistic about its business prospects despite the tax increase.
