Brazil’s Supreme Court Blocks Loterj’s Nationwide Operations
In a recent decision by Brazil’s Supreme Federal Court (STF), it has been ruled that the Loteria do Estado do Rio de Janeiro (Loterj) cannot extend its operations beyond state lines. The majority of justices agreed on this ruling during a virtual plenary session, supporting an earlier order from Minister André Mendonça.
Legal Battle Against Loterj
The legal battle began when the federal government, represented by the Attorney General’s Office (AGU), filed a lawsuit against Loterj for attempting to license betting firms for nationwide operations. The AGU argued that this move would disrupt fair competition, weaken federal control, and violate national gambling regulations.
In response to the AGU’s legal action, Minister Mendonça issued an injunction in January 2025, halting Loterj’s expansion plans and changes to its licensing rules. Justices Gilmar Mendes, Alexandre de Moraes, Flávio Dino, Dias Toffoli, Cármen Lúcia, and Cristiano Zanin supported the Minister’s stance, emphasizing that states must adhere to federal laws when it comes to controlling lottery services within their respective territories.
Following the STF’s ruling, Loterj is prohibited from allowing betting companies to operate outside Rio de Janeiro and must implement geolocation tracking to ensure all bets on approved platforms originate from within the state. This measure aims to prevent operators from circumventing geographical restrictions and ensure compliance with federal regulations.
