Parimatch, a prominent player in the online casino industry, has emerged triumphant in a protracted legal battle over trademark issues. The England and Wales High Court recently ruled in favor of Parimatch, dismissing substantial claims against the company.
The legal dispute centered around the termination of a licensing agreement in the Turkish grey market and saw Parimatch facing off against Abudantia BV, a company providing gaming services to other businesses. Abudantia alleged that Parimatch, along with its affiliated companies Fastron and Rillius, violated the law by terminating a Trademark Licensing Agreement (TLA) for an online gambling platform and engaging in anti-competitive behavior. However, the court ultimately sided with Parimatch, determining that the company had the right to end the agreement.
The Beginning of the Conflict
The conflict between Parimatch and Abudantia began when the two entities collaborated to enter the Turkish online gaming market. Due to the ambiguous regulations in Turkey, Parimatch sought to enter the market discreetly. The partnership started with a white-label deal that later evolved into a joint venture.
Under the agreement, Abudantia operated a website under the name Paribahis.com, utilizing the Parimatch brand. The initial contract was set to run for a year from January 2021, with the option for renewal if both parties were satisfied with the collaboration. However, disagreements arose in December 2021 when Fastron decided to terminate the cooperation, citing dissatisfaction with the platform’s performance. Abudantia countered by claiming that the agreement had automatically renewed and accused Parimatch-linked companies of attempting to drive them out of the market.
Court Ruling and Criticism
The court ruled that the TLA expired on January 9, 2022, without automatic renewal. It found that Abudantia failed to demonstrate meeting the performance criteria necessary for the agreement’s continuation.
However, the court criticized Parimatch for fabricating a false narrative regarding its activities in Turkey, creating misleading evidence to defend its trademark. This strategy aimed to safeguard the company against regulatory scrutiny. Despite this deception, the court did not view Parimatch’s actions as a conspiracy to harm Abudantia’s business but rather as an attempt to uphold its brand reputation.
Parimatch’s Strategic Moves
Parimatch also made strategic moves to sever ties with Abudantia, including notifying business partners that the use of the Parimatch trademark was no longer permitted. Additionally, an attempt was made to acquire the Paribahis.com domain through the World Intellectual Property Organization (WIPO), which was ultimately rejected due to lack of transparency regarding past relationships.
