Campaign for Fairer Gambling Report Reveals Alarming Trends in Online Gambling
The Campaign for Fairer Gambling (CFG) has recently released a report in collaboration with market intelligence platform Yield Sec, shedding light on the concerning increase in consumer losses related to online gambling in states that have legalized the activity without proper regulation of the unlicensed market.
Key Findings of the Report
The report categorizes US states into three regulatory groups based on their approach to online gambling: those with no legal online gambling, those allowing online sports betting only, and those permitting both online sports betting and online casino games.
According to the analysis, states with no legal online gambling report significantly lower losses, with an average of 0.31% of income per capita. In contrast, states that have legalized online sports betting see an increase in gross gaming revenue (GGR) per capita to 0.77% of average income. The figure rises even further in states that have legalized both online sports betting and online casino games, reaching 1.12% of income per capita.
Challenges with Unlicensed Operators
The report also highlights the prevalence of unlicensed gambling operators in the market, capturing a significant 74% of the online GGR in the US. These operators can offer consumers more attractive incentives, such as larger bonuses and fewer restrictions, as they do not have to comply with taxes and licensing fees.
The lack of strict monitoring and enforcement allows unlicensed operators to thrive, posing a direct threat to licensed providers and the overall integrity of the regulated gambling industry.
Call for Regulatory Overhaul
The CFG argues that the current regulatory strategies in certain states are failing to effectively control the online gambling landscape. States like New York and Florida, which have legalized sports betting but not online casino gambling, are witnessing a surge in per capita gambling losses.
In contrast, states like Michigan and New Jersey, where both sports betting and online casino gambling are legal, experience a more significant impact on consumer income. The report challenges the “zero-sum” theory, suggesting that the growth of licensed gambling does not necessarily diminish the unlicensed market but rather fuels its expansion.

The CFG and Yield Sec advocate for a regulatory overhaul that focuses not only on legalization but also on robust enforcement against unlicensed gambling platforms. Without stringent measures in place, the legal industry struggles to compete effectively, leading to an overall growth in the market, including the unlicensed sector, and increased financial harm to consumers.
